Warwickshire League champions Berkswell will be allowed to play in the Birmingham & District Premier League next season after all.

Berkswell, captained by former Warwickshire batsman Dominic Ostler, lost only one game in sweeping to the Warwickshire League title but their celebrations were dampened when the Birmingham League's management board announced earlier this month that they would not be promoted, because they did not run a Saturday third XI last season.

Berkswell, whose ground and youth section passed a Birmingham League audit, argued that they would be able to run a third team in an approved Saturday league in 2006 and lodged an immediate appeal.

Their case was put by Clive Brown, chairman of the Boundary Sports Warwickshire League, to another meeting of the Birmingham League's management board at Moseley on Tuesday and the appeal was upheld.

Berkswell will now replace Pershore in the Third Division and will officially become members at the Birmingham League's annual general meeting in January.

Berkswell, who have recently spent around £250,000 on a new clubhouse, included Holland opener Daan van Bunge and Denmark ' s wicketkeeper- batsman Freddie Klokker in their title-winning squad.

Ostler took over the captaincy of his local village club after he retired from first- class cricket 12 months ago.
